Delayed or Missing Holiday Package? Use ChatGPT to Know Your Delivery Rights, Write the Status Email and Skip Fake Delivery Texts

Ordered a gift that’s stuck “in transit,” marked delivered but nowhere to find, or never shipped? Here’s how U.S. rules say online sellers must ship and refund you, how to track and search a real USPS package, and how ChatGPT can draft a calm status email — plus how to spot fake “your package is on hold” texts. Rules come from the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435), USPS, USPIS and the CFPB. 6 copy-paste prompts.

Quick answer: For most online and phone orders in the U.S., the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435) says the seller must ship within the time it clearly promised, or within 30 days of a properly completed order if no time was stated (50 days if you applied for the seller’s credit when you ordered). If it can’t ship on time, it must offer you — without you having to ask — a choice to agree to a delay or cancel for a prompt refund. A “prompt refund” under the rule is usually sent within 7 working days. Paste the store’s shipping update into ChatGPT (cover order numbers and card digits first) and ask what to request next. Track real packages only on the carrier’s own site or app — the U.S. Postal Inspection Service says USPS won’t text you a link unless you asked for tracking.

Important: ChatGPT is a helper, not a lawyer, the store or the Post Office. It can make mistakes, so check anything it says against the FTC rule (eCFR Part 435, linked below), the seller’s order page and the carrier’s tracking. Never paste card numbers, passwords, one-time codes or full account numbers into a chat. Cover your order number and tracking number in screenshots if you don’t need ChatGPT to quote them back. This guide is general consumer information, not legal advice.

Why this is worth 10 minutes in November

Thanksgiving is Thursday, November 26, and Black Friday / Cyber Monday (Nov 27–30) kick off the busiest shipping weeks of the year. That’s when tracking stalls, “delivered” packages go missing from porches, and scam texts about a “held” package spike. Ten minutes now — know the 30-day ship rule, save two prompts, bookmark the real tracking site — means you won’t panic-click a fake delivery link or accept a vague “please wait” when you’re owed a cancel-and-refund option.

Phone-ok: everything here works in the ChatGPT phone app. Screenshot the store’s email or tracking screen, tap + to add it, and paste a prompt. OpenAI’s file-upload help page (checked Nov 5, 2026) says document and image uploads are available on Free and paid ChatGPT plans on the web and supported mobile apps. Cover card digits and passwords first. New to uploads? See how to upload a photo or PDF to ChatGPT.

Your shipping and refund rights in plain English (FTC rule)

From 16 CFR Part 435 — the Mail, Internet, or Telephone Order Merchandise Rule — on eCFR, displaying title 16 up to date as of Nov 4, 2026 (checked Nov 5, 2026). It covers merchandise you ordered by mail, Internet or telephone.

SituationWhat the rule says
Seller stated a ship-by dateMust have a reasonable basis to ship by that date.
No ship-by date statedMust ship within 30 days after a properly completed order ( 50 days if you applied for the seller’s credit at order time).
Seller can’t ship on timeMust offer you, clearly and without your asking, a choice to consent to a delay or cancel and get a prompt refund — by the original deadline.
You cancel under that option (before it ships)Seller must treat the order as canceled and make a prompt refund.
Long delay notice (revised date more than 30 days out, or “we don’t know how long”)Order is automatically canceled unless the seller ships within 30 days of the original deadline or you specifically agree to the delay. If you agree to an indefinite delay, you can still cancel anytime before it ships.
Seller says it won’t shipMust notify you and send a prompt refund.
What “shipment” meansThe merchandise is physically placed with the carrier — not just “label created.”
What “prompt refund” meansUsually a refund sent within 7 working days of when your right to a refund starts (some credit-account cases: within one billing cycle).
Seller first, then your card. Start with the store’s official order page or support chat (typed yourself, not from a text link). If you paid by credit card and still can’t fix it, the CFPB says to call your card company right away and send a written billing error notice within 60 calendar days after the charge appeared on your statement; the company then has 30 days to confirm it got your dispute.

Tracking and missing packages (USPS)

From USPS’s Missing Mail and Lost Packages and File a Claim pages (checked Nov 5, 2026). Steps are similar in spirit for UPS/FedEx: use that carrier’s own app or website.

  1. Check tracking on the carrier site you typed or opened from the store’s order page — not from a text link.
  2. USPS Missing Mail search: USPS says you can submit a Missing Mail search request starting 7 days from mailing, with your tracking number and mailing date from the receipt.
  3. Insurance claims: for damaged or missing contents, USPS recommends filing a claim immediately, and says you must file no later than 60 days from the date of mailing (insurance required).
  4. Still missing after “delivered”? Check with neighbors, building staff and any photo-on-delivery in the carrier app; then contact the seller (they’re usually responsible for getting it to you) and use prompt 2.

6 copy-paste prompts for a stuck or missing package

Fill in the [BRACKETS]. Cover card numbers, passwords and one-time codes before you paste or upload anything.

1. 📦 “Is the seller past the ship deadline?”

I ordered [ITEM] online from [STORE] on [DATE].
They promised to ship by [DATE or "no date stated"].
Today's date is [TODAY]. Tracking / status says:
[PASTE UPDATE, personal numbers covered].
Using the FTC Mail Order Merchandise Rule I'll paste
below, tell me:
1) What was their shipping deadline?
2) Are they past it?
3) What options should they offer me (delay consent
   vs cancel + prompt refund)?
4) What should I ask for in one short sentence?
Rule summary: ship by promised date, or within 30 days
of a properly completed order if none was stated
(50 days if I applied for their credit when ordering).
If they can't, they must offer cancel + prompt refund
(usually within 7 working days) without me asking.
If anything is unclear, say so instead of guessing.

2. 📧 “Write my polite status / cancel email”

Write a short, polite message to [STORE] about order
[ORDER # I'll fill in myself]. Facts: ordered [DATE],
promised ship by [DATE / none stated], current status
[PASTE]. I want [a firm ship date / to cancel for a
refund to my original payment]. Mention the FTC Mail
Order Rule's 30-day default and prompt-refund idea in
plain words, not legalese. Under 120 words. Leave blanks
for order number and last 4 of my card. Don't invent
facts.

Send it through the store’s official order help, app or the email on its website — not a number from a text. More email help: write emails with ChatGPT.

3. 📍 “Read this tracking update”

Here's my carrier tracking text (numbers partly covered):
[PASTE]. In plain English: where is the package, what
does the latest scan mean, what are 3 normal next steps,
and what would be unusual enough to contact the seller
today? Don't invent scans that aren't in the text.

4. 🚩 “Is this delivery text a scam?”

I got this text/email about a package (my details
removed): [PASTE]. List red flags. The U.S. Postal
Inspection Service says USPS will not text or email a
link unless I first requested tracking with a tracking
number, and those messages will NOT contain a link.
Tell me the safe way to check (type the carrier site
myself) and where to report a fake USPS text
(spam@uspis.gov, forward to 7726).

Full walkthrough: Is this a scam? Check it with ChatGPT.

5. 🧾 “Delivered but I don’t have it”

Tracking says "delivered" on [DATE/TIME] to [general
area, no full address], but I don't have the package.
Help me make a checklist: check porch/side door/garage,
neighbors, building staff, delivery photo in the app,
then a short note to the seller asking for a reship or
refund. Keep it calm and factual. Under 100 words for
the note.

6. 💳 “Card dispute notes (after I tried the seller)”

I contacted [STORE] on [DATE] about [never shipped /
missing after "delivered"]. Here's what they said:
[PASTE]. Help me outline a written billing error notice
for my credit card company: what I ordered, amount,
dates, what I already tried, and what I want (remove
the charge). Remind me the CFPB says to call the card
company and send written notice within 60 calendar days
after the charge appeared on my statement. Leave blanks
for account details — I'll fill those myself. No threats.

How Bot Club works

Step 1: Before you worry (5 minutes)

  1. Open the store’s order page from a bookmark or by typing the site — confirm the promised ship date and current status.
  2. Open tracking on the carrier’s site or app the same way. Save a screenshot of the latest scan.
  3. Start the 30-day clock (or the promised date). Mark your calendar for when you’ll cancel if it still hasn’t shipped.
  4. Ignore unexpected delivery texts with links. USPIS: if you didn’t request USPS tracking for that number, don’t tap the link.

Step 2: When it’s late or missing

  1. Use prompt 1 to see whether the seller is past the FTC deadline.
  2. Send prompt 2’s email through the store’s official help channel. Ask for a firm ship date or a cancel + refund to your original payment.
  3. “Delivered” but gone? Do the porch / neighbor / photo check, then prompt 5 to the seller.
  4. USPS and 7+ days since mailing? Consider a Missing Mail search on USPS.com; use insurance claims only if the package was insured.

Step 3: Avoid fake delivery texts

The U.S. Postal Inspection Service page “Smishing: Package Tracking Text Scams” (checked Nov 5, 2026; page last updated May 19, 2025) says:

  • Unsolicited texts with a strange link about a USPS delivery that “needs your response” are a common smishing scam.
  • USPS tracking texts/emails only come after you request tracking with a tracking number, and they will not contain a link.
  • USPS does not charge for those tracking tools.
  • Expecting a real package? Don’t click the link — go to USPS.com yourself.
  • Already tapped a bad link? Tell your bank or card issuer.
  • Report fake USPS texts: email spam@uspis.gov (paste the text, your name, screenshot of sender number and date; say if you clicked, lost money or shared info), and forward the text to 7726. Also use ReportFraud.ftc.gov and, for online crime, ic3.gov.

Same idea for “UPS/FedEx/Amazon” texts from unknown numbers: open the official app yourself. More practice: Is this a scam?

Step 4: Still not fixed?

  • Credit card: CFPB — call the card company, then send a written billing error notice within 60 calendar days after the charge on your statement (prompt 6). Keep copies.
  • Report a bad seller or scam: ReportFraud.ftc.gov; USA.gov’s where-to-report tool points you to the right agency.
  • Holiday shopping still ahead? Pair this with holiday shopping with ChatGPT (budget + ship-by dates) and this morning’s flight cancel/delay refund rights if you’re traveling too.

Privacy tips

  • ChatGPT only needs dates, status words and what you were offered — not full card numbers or passwords.
  • Cover tracking and order numbers in screenshots when the prompt doesn’t need the exact digits.
  • You send the final email or dispute yourself through official channels. ChatGPT drafts; you decide.

Troubleshooting

  • ChatGPT disagrees with this page. Paste the eCFR rule summary from prompt 1 and ask it to re-check. The FTC rule wins.
  • Store says “just wait” with no cancel option. The rule says they must offer cancel + prompt refund when they can’t ship on time. Ask for that option in writing (prompt 2 / 9).
  • “Label created” for days. Under the rule, shipment means the item was given to the carrier. Ask whether it actually shipped (prompt 15 for members; prompt 3 free).
  • Can’t upload a screenshot. Copy the email or tracking text and paste it instead.

Quick FAQ

How long does an online seller have to ship my order?

Under the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435), the seller must ship by the date it clearly promised, or within 30 days of a properly completed order if no date was stated (50 days if you applied for the seller’s credit when you ordered).

What if my order is late and hasn’t shipped?

If the seller can’t ship on time, the rule says it must offer you — without you asking — a choice to agree to a delay or cancel for a prompt refund. A prompt refund is usually sent within 7 working days. Contact the seller through its official site or app.

Tracking says delivered but I don’t have the package. What now?

Check porches, side doors, neighbors, building staff and any delivery photo in the carrier app, then contact the seller for a reship or refund. For USPS, a Missing Mail search can start 7 days from mailing; insured packages may qualify for a claim filed within 60 days of mailing.

I got a text that my USPS package is on hold with a link. Is it real?

Often it’s a scam. The U.S. Postal Inspection Service says USPS will not text or email a link unless you first requested tracking with a tracking number, and those messages will not contain a link. Don’t tap it — go to USPS.com yourself. Report fakes to spam@uspis.gov and forward the text to 7726.

Can I dispute the charge on my credit card?

Yes, after you’ve tried the seller. The CFPB says to call your card company right away and send a written billing error notice within 60 calendar days after the charge appeared on your statement. Keep copies of everything.

Is ChatGPT allowed to see my tracking number?

You can paste status text with numbers partly covered. Never paste card numbers, passwords or one-time codes. OpenAI says image and document uploads work on Free and paid ChatGPT plans; cover private digits in screenshots first.
